Privacy Policy

ExxonMobil Australia Pty Ltd has a number of affiliates, many with names that include ExxonMobil, Exxon, Esso, Mobil and Ampolex. For convenience and simplicity in this policy, those terms and the terms corporation, company, our, we and its are sometimes used as abbreviated references to specific affiliates or affiliate groups. This policy applies to those affiliates or affiliate groups which are incorporated in Australia or run a business which has operations in Australia and collects or holds personal information either in Australia or an external territory or collects personal information of individuals who are Australian citizens.

Your Privacy

Your privacy is important and we want you to understand our practices with respect to gathering personal information and with respect to the uses we make of personal information.

Privacy deals with personal information, that is, information that could identify a specific individual or entity such as names, addresses, email addresses and telephone numbers. If, for example, you complete an order form, enter a contest, enter into an agreement or arrangement with us, or submit other information to us, you may provide us with personal information. Information about you may also be provided to us by someone else. We may collect and use that personal information to provide you with products or services, to bill you for products and services you request, to market product and services which we think may be of interest to you, or to communicate with you for other purposes.

In the event we do collect personal information from you the following describes the standards we apply in handling that information.

National Privacy Principles

This privacy policy is compliant with the Privacy Act 1988 (Cth), its National Privacy Principles and other applicable legislation incorporating privacy provisions. In applying the National Privacy Principles we seek to protect an individual's privacy by ensuring that the handling of personal information by us is always fair.

Use and Disclosure of your Personal Information

At or before the time we collect personal information from you or about you or as soon as practicable after, we will take reasonable steps to ensure that you are made aware of:

  1. the purpose for which the information is collected and the consequences (if any) of not collecting it;
  2. in general terms any parties to which the information may be disclosed; and
  3. if applicable, any law requiring the collection will be identified.

However, in many cases our intentions with respect to the information will be apparent from the circumstances of the collection, in which case no additional steps to inform you of those intentions will be necessary.

We do not collect or use personal information for any purpose other than that for which it was collected or a purpose related to the same. If we wish to use your personal information for a new purpose unrelated to the purpose of collection, we offer you the means to consent to this new purpose.

We do not generally collect sensitive information. If the personal information concerned is sensitive information then its collection, use or disclosure by us is conditional upon your consent. This includes information about your race or ethnic origin, politics, religious or philosophical beliefs, membership of a professional or trade association or union, sexual preferences or practices, health or a criminal record.

Where you have provided personal information to us for a purpose we will assume that you have consented to the collection, use and any disclosure of that information necessary to fulfill that purpose, unless you tell us otherwise.

As related bodies corporate, affiliates of ExxonMobil Australia Pty Ltd often disclose personal information to each other.

Where we wish to disclose your personal information to a third party for purposes that are different from and unrelated to those for which it was collected, we offer you the opportunity to consent to disclosure.

Should the disclosure or transfer of your personal information be to an affiliate or third party in a foreign country then the disclosure will only occur:

  1. where we believe or we have taken measures to ensure that the information will be subject to principles similar to the National Privacy Principles; or
  2. upon your consent; or
  3. for the performance of a contract with you, or necessary for the conclusion of a contract in your interest; or
  4. where the disclosure is for your benefit and although it is impracticable to obtain your consent we believe you would be likely to consent to the disclosure.

We ensure that your personal information will not be otherwise disclosed without your consent except if necessary to prevent a threat to life or health, required by law or other regulations, reasonably necessary to enforce a law or necessary to investigate suspected unlawful activity.

Opt-Out

We will provide an opt-out opportunity with direct marketing offers.

Security of your Personal Information

We have implemented security policies, rules and technical measures to protect the personal information that we have under our control from:

  1. unauthorised access
  2. improper use or disclosure
  3. unauthorised modification
  4. unlawful destruction or accidental loss.

All our employees and contractors, who have access to, and are associated with the processing of personal information, are obliged to respect the confidentiality of our records.

Quality of your Personal Information

We take reasonable steps to ensure that your personal information is accurate, complete and up-to-date whenever we collect or use it.

Queries, Accessing Records and Complaints

If you wish to access the personal information we may hold about you, contact us by telephone on 1800 631 296. Our customer service centre will help you with your request.

We will aim to provide you with a readable copy of the personal information we keep about you, within a reasonable time following the receipt of your request. We will endeavour to provide the information without any charge. However, we reserve the right to charge in exceptional circumstances; such circumstances could be where the information has to be retrieved from archives, or a large quantity has been requested. Such charges will represent actual costs of providing the information to you; we will not profit from your request.

You may need to put your request in writing and we will often require proof of your identity before providing the information.

Access to your personal information held by us is generally available. However, there may be reasons why we are unable to comply with your request for access, in which event you will be advised of those reasons.

We allow you to challenge the personal information we hold about you. If it is established that the information is not accurate, complete and up-to-date, we will take reasonable steps to correct the information. If we disagree with a claim that personal information held by us is not accurate, complete and up-to-date you may have us attach an appropriate statement in this respect to the record.

If you have any query on how your personal information is collected or used or are otherwise concerned about the treatment of personal information we may hold about you, details of your query or complaint can be provided to our customer service centre by telephone on 1800 129 353. We have a formal procedure for dealing with complaints and our customer service centre may ask you to put your complaint in writing. We want to hear from you if you have a complaint, as your privacy is important to us.

Changes to this Statement

This policy was adopted on 21 December 2001. We reserve the right to change this policy as necessary. Any changes to this policy will be updated on this website, so please visit the website periodically to ensure that you have our most current policy.

Employee Records

This policy is not intended to cover employee records, namely records of personal information relating to the employment of an employee of those affiliates or affiliate groups.

HOW WE OFTEN COLLECT, USE AND DISCLOSE PERSONAL INFORMATION

A collection of your personal information will often occur when contacting us by telephone or in person or by sending us correspondence or on visiting our web sites. Information about you may also be obtained from third parties, for example:

  • service providers or suppliers who collect information on our behalf and who market our products and services including service station dealers and distributors;
  • market research companies contracted by us to obtain information so that we may improve and market our products and services.

Some of the personal information we collect is essential for us to be able to process a transaction. Other types of information we collect helps us market our products or services. We generally collect your personal information for the following purposes:

  • to process the provision of our services or products and other transactions; and
  • conduct marketing activities and market research.

Although infrequent, we also collect personal information to liaise with communities in which we operate or to respond to requests for sponsorship or requests concerning initiatives we already sponsor.

We may disclose personal information to third parties for the purpose for which the personal information was collected or for a related purpose, for example, to our contractors to whom we contract out the provision of certain services or other independent parties who market and supply our products such as service station dealers and distributors. Our community liaison may include providing comment to representative, media or other organisations on issues concerning us; such comment may include personal information.

We may also engage third parties to perform services for us which involves the handling of personal information we hold, for example:

  • to assist with obtaining payment from creditors;
  • to provide associated support services such as freight, catering, cleaning or security;
  • to conduct market research or marketing, including promotions and competitions;
  • to process and/or operate some sales functions;
  • to operate call centres;
  • to provide electronic funds transfer services, credit card account processing and related services; and
  • to handle and process mail, email, application forms, telephone enquiries and other correspondence.
